Another public agency sues a records requestor in strategic “first strike.” A May 20th Middlesex County hearing and subsequent ruling may help to end the practice and establish that only a requestor has the right to bring an OPRA lawsuit in line with the intent of the law. -NJFOG

UPDATE: On June 10, Judge Travis L. Francis issued an oral decision in the case. He ruled that the Middlesex County Prosecutor could not file for a protective order (pre-emptive lawsuit) to block release of records and that only a records requestor can file an OPRA action! NJFOG is seeking a copy of the signed order.
